2/13.04.2017 The petitioner is apprehending his arrest in connection with Saraikella P.S. Case No.29 of 2017, corresponding to G.R. Case No.206 of 2017, registered under Sections 420 of the Indian Penal Code and Rules 4 and 54 of the Minor Mineral Concessions Rules.

It is submitted by learned counsel for the petitioner that petitioner is falsely implicated in this case and he was transporting stone chips after having a valid challan issued in Form-D.

Learned A.P.P. appearing for the State has opposed the prayer for bail.

In the facts and circumstances of the case, as stated above, the petitioner is directed to surrender in the court below within four weeks from today and in the event of his surrender/arrest, the petitioner named above, shall be released on anticipatory bail, on furnishing bail bond of Rs.10,000/(Ten Thousand), with two sureties of the like amount, to the satisfaction of learned C.J.M, Saraikella in connection with Saraikella P.S. Case No.29 of 2017, corresponding to G.R. Case No.206 of 2017, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. and subject to the further condition that on the date of surrender, petitioners shall deposit Rs.4,000/- in the court below which shall be subject to the result of the case.
