The petitioner is apprehending his arrest in connection with Ramgarh P.S. Case No. 25 of 2016, corresponding to G.R. No. 100 of 2016, for the offence registered under sections 414/34 of the Indian Penal Code and under section 30(ii) of Coal Mines Act and under section 33 of the Indian Forrest Act.

The learned counsel appearing on behalf of the petitioner has submitted that the petitioner has been falsely implicated in this case. It is further submitted that the petitioner is the owner and driver of the truck bearing Reg. No. JH-02H-5609 who plied the said truck on hire.

Learned A.P.P opposed the prayer for anticipatory bail.

Be that as it may, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of the court of learned C.J.M, Ramgarh, in connection with connection with Ramgarh P.S. Case No. 25 of 2016, corresponding to G.R. No. 100 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C and also subject to the condition that the petitioner will deposit Rs. 8,000/- before the court below on the date of his surrender. However, deposition of aforesaid amount would be subject to the result of the case.
