The petitioner is apprehending his arrest in connection with Giridih(T) P.S. Case No. 343 of 2016, corresponding to G.R. No. 3156 of 2016, registered under sections 420, 467, 468, 471, 120B, of the Indian Penal Code.

The learned counsel appearing on behalf of the petitioner has submitted that the petitioner has been falsely implicated in this case. It is further submitted that according to the F.I.R, the original power of attorney which was said to have been drafted by the petitioner described plot no. 116. There had been no interpolation or change of plot number whereas it was registered and issued to the person who granted such power of attorney to the accused no. 3. It is further submitted that the power of attorney is not a document of transfer. No right, title or interest is transferred on the basis of power of attorney. The persons who granted such power of attorney and the person in whose favour power was granted are also accused persons. It is further submitted that a civil suit being Title Suit No. 124 of 2009 is pending between Jagdish Mahto (the person who gave information to the informant) and the accused Gudda Rai and others. The petitioner is suffering from various ailments including liver problem, acute thyroid problem as well as diabetes.

Learned A.P.P opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten

thousand), with two sureties of the like amount each to the satisfaction of the court of learned C.J.M, Giridih, in connection with connection with Giridih(T) P.S. Case No. 343 of 2016, corresponding to G.R. No. 3156 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
