06/ 14.03.2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner has been made accused for the offences under Sections 147, 148 and 149 of the Indian Penal Code, Sections 25(1-B)(a)/26/35 of the Arms Act and Sections 17of the CLA Act, in connection with Pathalgodda P.S. Case No. 10 of 2015 corresponding to G.R. No. 358 of 2015.
The FIR shows that the petitioner was apprehended on 24.3.2015 while the police raided the group of extremists and from the possession of this petitioner, one country made pistol and two cartridges were recovered.
In the facts of this case, I am inclined to enlarge the petitioner, Rakesh Kumar Chandrabanshi @ Chhotu @ Karan Jee, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned C.J.M. Chatra, in connection with Pathalgodda P.S. Case No. 10 of 2015 corresponding to G.R. No. 358 of 2015.
