3/ 11.03.2016 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.

The petitioner has been made accused for the offences under Sections 302 / 385 / 34 of the Indian Penal Code and Section 27 of the Arms Act, in connection with Dhurwa (T) P.S. Case No. 243 of 2015 corresponding to G.R. No. 5469 of 2015.

The case relates to double murder and though the petitioner is named in the FIR, but it is apparent from the FIR that the informant is not the eyewitness to the occurrence, but the petitioner has been named on the basis of suspicion. There is allegation against one named accused and other unknown persons to have assaulted the deceased.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and has prayed for bail.

Learned counsel for the State has opposed the prayer for bail, but upon going through the case diary, it is admitted that there are only confessional statements against the petitioner.

In the facts of this case, I am inclined to enlarge the petitioner, Ranjit Kumar Sharma @ Ranjeet Sharma, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of Sri C.B. Kumar, learned Judicial Magistrate, Ranchi, or his successor, in connection with Dhurwa (T) P.S. Case No. 243 of 2015 corresponding to G.R. No. 5469 of 2015.
