Heard learned counsel for the parties.

The petitioner has been made an accused in connection with Gumla P.S. Case No. 275 of 2012, corresponding to G.R. No. 845 of 2012, S.T. No. 58 of 2014, for the offence registered under Sections 364/34, 302, 201/34 of the Indian Penal Code and under Section 17 of C.L.A Act.

Learned counsel for the petitioner has submitted that petitioner is in custody since 01.08.2013 and till date eleven witnesses have been examined who have not supported the case.

Learned A.P.P has opposed the prayer for bail.

¶10

It appears that vide order dated 11.07.2016 status report was called from the concerned court and the said report dated 28.07.2016 has been received, in which it has been stated that till date 11 witnesses have been examined, three witnesses is still to be examined and the expected time frame for conclusion of trial is three months.

In the facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage, accordingly, his prayer for bail stands rejected. The trial court is directed to conclude the trial within three months from the date of receipt of a copy of this order, and if the same is not concluded within the aforesaid period, the petitioner is at liberty to renew his prayer for bail.

Let a copy of this order be communicated to the concerned trial court.
