Heard Mr. Bharat Kumar, learned counsel, appearing for the petitioners. No one appears for the State.

Petitioners have prayed for grant of anticipatory bail, as they are apprehending their arrest in connection with Markacho P.S. Case No. 22 of 2015 (G.R. No. 291 of 2015), registered for the offences punishable u/s 323,341,448,379,354,504 and 34 of the Indian Penal Code.

It has been submitted by learned counsel for the petitioners that with respect to 4 decimals of land which is claimed to have been purchased by the informant, but in fact the same was sold to the petitioners No. 1 and 5 much prior to the purchase made by the informant. It has further been submitted that subsequently the informant had purchased the same plot of land from one Puniya Devi who happens to be sister of Gaurwa Devi from whom the petitioner No. 1 and 5 had purchased the land.

Since the dispute appears to be with respect to the ownership of the plot of land from which the petitioners are alleged to have taken out potato, I am inclined to allow this application. Accordingly, the petitioners, named above, are directed to surrender in the court below within three weeks from today and on such surrender, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Koderma in connection with Markacho P.S. Case No. 22 of 2015 (G.R. No. 291 of 2015), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
