The petitioner has been made an accused for the offence registered under Sections 395, 412, of the Indian Penal Code.

Heard Learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner has submitted that the petitioner has been made an accused on the basis of confessional statement of co-accused. It is submitted that the petitioner was apprehended in Balumath P.S. case No.129/15 and thereafter he was remanded in this case. That the motorcycle was recovered from the house of the petitioner is not a looted motorcycle neither the said motorcycle was identified by the informant or any other witnesses. It is submitted that in similar circumstances co-accused namely, Ritesh Yadav @ Ritesh Kumar Yadav & Ajay Yadav, Hemant Kr. Yadav, Ankit Kumar and Surendra Kumar Yadav have been granted bail in B.A.Nos. 2430/16, 3440/16, 2897/16, 3495/16 respectively.

Learned counsel for the State has opposed the prayer for

bail.

Considering the fact that on similar allegation co-accused have been granted bail and the said motorcycle recovered has not been identified, petitioner is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rs Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge, Latehar in connection with Balumath P.S. Case No. 123 of 2015 corresponding to G. R. No. 813 of 2015 and S.T.No.22/2016, subject to the condition that the petitioner shall be present as and when directed by the trial court till conclusion of the trial.
