Learned counsel for the petitioner has submitted that earlier the prayer for bail of the petitioner was rejected vide order dated 08.07.2015 in Cr. Revision no. 1073 of 2015 with the observation that since the petitioner has remained in custody for nearly 2 years and if inquiry is not concluded within four months, the petitioner was given the liberty to renew his prayer for bail. It is submitted that the petitioner has been falsely implicated on account of village politics. That he has remained in custody since 09.09.2013 and enquiry is yet to be concluded, hence, he deserves to be enlarged on bail. That the father of the petitioner is ready to undertake that he shall ensure proper supervision and good behaviour of the petitioner.
Learned A.P.P. has opposed the prayer for bail and submitted that there is allegation of commission of rape on a minor girl aged about 14 years against the petitioner and enquiry is to be concluded.
Heard. It transpires from the record that the petitioner shall complete 3 years in custody on 08.09.2016, accordingly, the prayer for bail of the petitioner is hereby, rejected at this stage.
