Heard learned counsel for the parties.
The petitioner has been made an accused in connection with Sadar P.S. Case No. 18 of 2016, corresponding to G.R. No. 108 of 2016, for the offence registered under Sections 392, 411 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is not named in F.I.R and he is in custody since 06.02.2016 and charge has already been framed on 19.05.2016. Petitioner has no criminal antecedent.
Learned A.P.P has opposed the prayer for bail and filed counteraffidavit. Referring to para 10 of the counter-affidavit, learned A.P.P has submitted that vide para 66 of the case diary, it appears that on the basis of confessional statement of the petitioner, part of the looted amount of Rs. 2700/-, has been recovered.
Considering the fact that petitioner is in custody since 06.02.2016, charge has already been framed, trial will take some time, I am inclined to grant bail to the petitioner, accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate at Chatra in connection with Sadar P.S. Case No. 18 of 2016, corresponding to G.R. No. 108 of 2016, subject to condition that one of the bailors must be close relative of the petitioner and the petitioner shall remain physically present before the Trial Court as and when his presence is required by the Trial Court, failing which it is open to the Trial Court to cancel the bail bond of the petitioner.
