02/ 20.04.2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner has been made accused for the offences under Sections 147, 148, 149, 385 and 436 of the Indian Penal Code and Section 17 of the C.L.A. Act, in connection with Churchu P.S. Case No. 9 of 2015 corresponding to G.R. No. 1824 of 2015.

There is allegation against 30-35 unknown extremists, apart from the named accused persons, to have burnt a vehicle. The petitioner is not named in the FIR.

Learned counsel for the petitioner has submitted that the petitioner

has been falsely implicated in this case and has prayed for bail.

Learned counsel for the State has opposed the prayer for bail.

In the facts of this case, I am inclined to enlarge the petitioner, Jagarnath Mahto, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/(ten thousand), with two sureties of the like amount each, to the satisfaction of Sri Ravi Shankar Mishra, learned Judicial Magistrate, Hazaribag, or his successor, in connection with Churchu P.S. Case No. 9 of 2015 corresponding to G.R. No. 1824 of 2015.
