Heard learned counsel for the parties.

The petitioners are apprehending their arrest in connection with Kasmar P.S. Case No. 22 of 2016, corresponding to G.R. No. 267 of 2016, for the offence registered under sections 341, 323, 324, 307, 452, 354, 504, 506 and 120B of the Indian Penal Code.

Learned counsel for the petitioners has submitted that petitioners have been falsely implicated in this case. There is no specific allegation against the petitioners. The injured had got simple injury. No offence as alleged against the petitioners is made out.

Learned A.P.P opposed the prayer for anticipatory bail and filed counter-affidavit. Referring to para, 9 the learned A.P.P has submitted that witnesses have fully supported the case of prosecution. Vide para 20 of the case diary, injury report has been mentioned.

In the facts and circumstances of the case, the above named petitioners are directed to surrender in the Court below within three weeks from the date of this order and in the event of their arrest or surrender the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of Sri Nirija Asri, learned J.M, Ist Class, Bermot at Tenughat, in connection with Kasmar P.S. Case No. 22 of 2016, corresponding to G.R. No. 267 of 2016, subject to condition as laid down under section 438(2) Cr.P.C and also subject to the condition that petitioner nos. 1 to 3 shall deposit Rs. 2,500/- each in the court below on the date of their surrender. Thereafter, court below shall issue notice to the informant, injured-Boby Devi and

injured Ram Prasad Sab and after their appearance, the court below shall release the

aforesaid amount in their favour after proper verification.
