The petitioner has been made accused in connection with S.T. No.427 of 2012, arising out of Panki P.S case No. 82 of 2007 corresponding to G.R No.1658 of 2007, for the offence under Sections 147, 148, 149, 364, 302 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of the CLA Act.

The case relates to murder of the son of the informant by the extremists and the informant is an eyewitness to the occurrence. The petitioner is named in the FIR, and there is allegation against the petitioner also in the FIR. Earlier the bail application of this petitioner was dismissed as withdrawn.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and the informant has since been examined in the Court below, but the informant has not identified the petitioner in the Court. The certified copy of deposition of the informant has been produced. Let the same be kept on record.

In the facts and circumstances of the case, I am inclined to enlarge the petitioner, Pramod Paswan @ Vidhya Manjhi, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-IV, Palamau at Daltonganj, in connection with S.T. No.427 of 2012, arising out of Panki P.S case No. 82 of 2007, corresponding to G.R No.1658 of 2007.
