Petitioner has been made accused for the offence under Sections 379, 353 of the Indian Penal Code, in connection with Latehar P.S. Case No.20 of 2016, corresponding to G.R. No.81 of 2016.
From the FIR, it appears that tractors loaded with stone, were apprehended by the forest officials, but the accused persons including the petitioner used force and made the tractors to escape. Petitioner is the owner of one of the tractors and it is alleged that he had also committed mischief damaging the vehicle of one of the forest officials.
In the facts and circumstances of the case, I am inclined to release the petitioner on bail. Accordingly, the petitioner Dhananjay Chaubey is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar, in connection with Latehar P.S. Case No.20 of 2016, corresponding to G.R. No.81 of 2016.
