Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with the case registered under Sections 341, 323, 325 and 307, 120(B) of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case due to some ulterior motive of the informant. It is also submitted that there is no specific overt act against the petitioner. It is also submitted that there is land dispute between the parties.

Learned A.P.P has opposed the prayer for anticipatory bail and produced the case diary referred to para 30 of the case diary it appears that informant has received grievous injury on his head by hard and blunt substance.

In the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within three weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Bokaro in connection with Chandankiary P.S. Case No. 178 of 2015 corresponding to G.R. No. 2386 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.Cand also subject to the condition that on the date of surrender petitioner will deposit Rs. 10,000/- in the trial Court as ad interim compensation.

After deposition of the amount the trial Court shall issue notice to the informant and on his appearance and after verification shall release the aforesaid amount.

Let copy of the order be sent to the trial Court.
