2/ 08.01.2016 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.

The petitioner has been made accused for the offence under Sections 147, 148, 149, 302 of the Indian Penal Code and Sections 3 and 4 of the Prevention of Witchcraft (Dain) Practices Act, in connection with Sisai P.S. Case No. 124 of 2015 corresponding to G.R. No. 583 of 2015, S.T. No. 389 of 2015.

The case relates to double murder, in which, father and mother of the informant were murdered. The informant appears to be the eyewitness to the occurrence. There is allegation against twelve named persons, including the petitioner, and about twenty unknown persons to have assaulted both the deceased.

It is submitted by learned counsel for the petitioner that there is only omnibus allegation against the petitioner in the FIR and in similar circumstance, other co-accused persons have been granted bail. Learned counsel has accordingly, prayed for bail.

Learned counsel for the State has opposed the prayer.

In the facts of this case, I am inclined to enlarge the petitioner, Durga Sahu, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned Addl. Sessions Judge-I, Gumla, in connection with S.T. No. 389 of 2015, arising out of Sisai P.S. Case No. 124 of 2015 corresponding to G.R. No. 583 of 2015.
