The petitioner has been made accused in connection with Simaria P.S. Case No.81 of 2013, corresponding to G.R No.1013 of 2013, for the offence under Section 414 of the Indian Penal Code, Section 17(i)(ii) of the Criminal Law Amendment Act and Section 25(1-B)(a)/ 26 of the Arms Act.
The petitioner was apprehended on 04.11.2013 and from the possession of the petitioner one country made semi-automatic pistol loaded with four cartridges was recovered. The petitioner was also found to be in possession of stolen motorcycle and mobiles and he was also found to be involved in extremist activities.
In the facts of this case, taking into consideration the period of custody of the petitioner, I am inclined to release the petitioner on bail. Accordingly, the petitioner, Nageshwar Ganjhu, is directed to be released on bail, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Civil Judge, Junior Division-1, Chatra, in connection with, Simaria P.S. Case No.81 of 2013, corresponding to G.R No.1013 of 2013.
