The petitioner has been made accused in connection with Bishnugarh P.S. Case No.12 of 2009, corresponding to G.R No.426 of 2009, for the offence under Sections 143, 144, 120-B of the Indian Penal Code and Section 17 of the C.L.A. Act.
The case relates to recovery of naxal literatures and other incriminating articles.
It is apparent from the F.I.R. that the petitioner was not apprehended at the spot, rather he has been named by the apprehended co-accused.
In the facts of this case, I am inclined to release the petitioner on bail. Accordingly, the petitioner, Ramji Manjhi, is directed to be released on bail, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri R.S. Mishra, learned Judicial Magistrate, 1st Class, Hazaribag, or his successor, in connection with, Bishnugarh P.S. Case No.12 of 2009, corresponding to G.R No.426 of 2009.
