The petitioner has been made accused for the offence under Sections 395 and 427 of the Indian Penal Code, in connection with S.T. No. 234 of 2014, arising out of Majhgaon (Kumardungi) P.S. Case No. 28 of 2014 corresponding to G.R. No. 318 of 2014.
The case relates to dacoity and the case was instituted against
unknown.
The impugned order shows that the petitioner has been made accused in this case only on the basis of the confessional statement of the co-accused as also on the basis of his criminal antecedents.
In the facts of the case, I am inclined to release the petitioner, Deepak Kumar Gope, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Chaibasa, in connection with S.T. No. 234 of 2014, arising out of Majhgaon (Kumardungi) P.S. Case No. 28 of 2014 corresponding to G.R. No. 318 of 2014.
