The petitioner is an accused in connection with S.T. No. 420 of 2012 (A) arising out of Rania P.S. Case No. 20 of 2008, corresponding to G.R. No. 239 of 2008 registered for the offence punishable under sections 386, 387, 414 of the Indian Penal Code and under section 25 (1-b)A, 26, 26(2), 35 of the Arms Act, under section 3/5 of the Explosive Substance Act, and section 17 (i)(ii) of the C.L.A. Act.
It has been submitted by the learned counsel for the petitioner that earlier the petitioner was granted bail by this Court in B.A. No. 7734 of 2009 on 27.11.2009. Subsequently, however, the petitioner was taken into custody on account of supplementary charge sheet submitted by the police under sections 3/5 of the Explosive Substance Act sowing the petitioner absconder. It has further been submitted that the similarly situated co-accused, namely, Ashram Gope has been granted bail by this Court in B.A. No. 8848 of 2014.
Learned counsel for the State has opposed the prayer for bail but has not disputed the aforesaid facts.
Regard being had to the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/(Ten thousand) with two sureties of the like amount each to the satisfaction of Sri O.P. Singh, the learned Addl. Sessions Judge 1st, Khunti, in connection with S.T. No. 420 of 2012 (A) arising out of Rania P.S. Case No. 20 of 2008, corresponding to G.R. No. 239 of 2008.
