Both these applications arise out of the same case and as such, they are being disposed of by this common order.

Heard learned counsel for the petitioners and learned counsel for

the State.

The petitioners have been made accused in connection with Basia P.S case No.53 of 2013 corresponding to G.R No.815 of 2013, for the offence under Sections 147, 148, 149, 447, 341, 323, 324, 307, 354, 504 of the Indian Penal Code and Sections 3 (IV, V, X, XI) SC / ST (POA) Act.

In the F.I.R., there is allegation against eleven named accused persons to have assaulted and injured the informant and others due to some land dispute. The petitioners are not named in the F.I.R.

Learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in this case subsequently and he has accordingly, prayed for bail.

Learned counsel for the State has opposed the prayer.

In the facts of this case, since the petitioners are not named in the F.I.R., I am inclined to enlarge the petitioners, Naim Khan, Shekh Hassan @ Hussain & Mansad Khan on bail. Accordingly, the petitioners, named above, are directed to be released on bail, on furnishing bail bonds of Rs. 10,000/(ten thousand) each with two sureties of the like amount each, to the satisfaction of Md. Naeem Ansari, learned Judicial Magistrate, 1^st class, Gumla, or his successor, in connection with Basia P.S case No.53 of 2013 corresponding to G.R No.815 of 2013.
