4/7.04.2015 Heard learned counsel for the petitioner and learned counsel for the State. Petitioner has been made accused for the offence under Sections 147/148/149/326/307/302/353/333/323/324/379/224/225/427/120-B of the Indian Penal Code, Section 27 of the Arms Act, Sections 3 / 4 of the Explosive Substance Act, Section 17 of the CLA Act, in connection with Giridih (Muffassil) P.S. Case No.290 of 2012, corresponding to G.R. No.2693 of 2012.
From the FIR, it appears that the prisoner extremists were produced before the Court and were being taken back to the jail, in the prisoner van, which was attacked by the extremists in order to enable the prisoner extremists to escape. It appears from the FIR that some police personal were killed in the occurrence and the prisoner extremists were made to escape. The prisoner extremists who escaped, also attacked the police party by bombs and had snatched away the rifles of the police party. Petitioner is not named in the FIR.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and in the similar circumstances, the other co-accused has been granted bail.
Learned counsel for the State has opposed the prayer for bail and has pointed out from the case diary that the petitioner was one of the prisoner extremists, who was made to escape in the said attack.
In the facts and circumstances of the case, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail stands rejected.
