05/ 07.04.2015 All these three bail applications arise out of the same case and as such, they are taken up together and disposed of by this common order.
Heard learned counsel for the petitioners and learned A.P.P. for the Prosecution.
The petitioners have been made accused for the offences under Sections 341, 307, 302 and 120-B of the Indian Penal Code and Section 27 of the Arms Act, in connection with Chutia P.S. Case No. 122 of 2014 corresponding to G.R. No. 3483 of 2014.
The case relates to murder and the case was instituted against one unknown person.
Learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in this case and has accordingly, prayed for bail.
Learned counsel for the State has opposed the prayer for bail.
The impugned order itself shows that the petitioners have been made accused in this case only on the basis of confessional statement.
In the facts of this case, I am inclined to enlarge the petitioners, Sanju Hembrom @ Sanju Hamrom, Biren Kumar @ Chhotu @ Viran Kumar, and Manish Dhan, on bail. Accordingly, the petitioners, named above, are directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of Smt. Sweta Kumari, learned Judicial Magistrate, 1st Class, Ranchi, or her successor, in connection with Chutia P.S. Case No. 122 of 2014 corresponding to G.R. No. 3483 of 2014.
