The petitioner has been made accused in connection with Manoharpur P.S. Case No. 08 of 2015, corresponding to G.R. No. 11 of 2015, for the offence under Sections 376(2)(i)/ 323/ 506 of the Indian Penal Code and Sections 4/ 6 of the P.O.C.S.O. Act.
There is direct allegation against the co-accused to have committed rape upon the minor girl. So far as this petitioner is concerned, there is no such allegation against him.
In the facts of this case, I am inclined to release the petitioner on bail. Accordingly, the petitioner, Lalu Malua, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Chaibasa, in connection with, Manoharpur P.S. Case No. 08 of 2015, corresponding to G.R. No. 11 of 2015.
