2/ 10.07.2015. Heard learned counsel for the petitioner and the learned counsel for the State as also learned counsel for the complainant.

The petitioner has been made accused in connection with Complaint Case No. 131 of 2012, for the offence under Sections 323, 341, 504 of the Indian Penal Code, Sections 3(1)(xii) of the S.C. / S.T. (POA) Act.

There is allegation against the petitioner to have sexually exploited the complainant due to which she became pregnant and she also delivered a child.

It appears that this is a third such case instituted against the petitioner by the complainant and in the earlier case the petitioner has been granted bail.

In the facts of this case, I am inclined to release the petitioner on bail. Accordingly, the petitioner, Manish Kumar, is directed to be released on bail, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar, in connection with, Complaint Case No. 131 of 2012.
