3/ 08.07.2015. Heard learned counsel for the petitioner and the learned counsel for the State.
The petitioner has been made accused in connection with Bishungarh P.S. Case No. 45 of 2015, corresponding to G.R. No. 1258 of 2015, for the offence under Sections 364 / 34 of the Indian Penal Code.
The case relates to abduction of two persons for levy. The case was instituted against unknown. It appears from the F.I.R. that both the victims were subsequently left by the culprits.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and has prayed for bail.
Learned counsel for the State has opposed the prayer and has pointed out from the case diary that the petitioner has been made accused on the basis of the confessional statement of the co-accused and there is recovery of some mobiles from the petitioner. However, it is admitted that the petitioner was not put on T.I.P.
In the facts of this case, I am inclined to release the petitioner on bail. Accordingly, the petitioner, Zabir Husain, is directed to be released on bail, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Hazaribag, in connection with, Bishungarh P.S. Case No. 45 of 2015, corresponding to G.R. No. 1258 of 2015.
