4/ 07.07.2015. Heard learned counsel for the petitioner and the learned counsel for the State as also learned counsel for the informant.
The petitioner has been made accused in connection with Gumla P.S. Case No. 208 of 2012, corresponding to G.R. No. 632 of 2012, for the offence under Sections 376, 498-A, 120-B, 34 of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.
There is allegation against the petitioner to have committed rape upon the complainant-informant and subsequently on the intervention of Anjuman committee both of them were married. It is alleged that soon after the marriage she was subjected to cruelty and torture for demand of dowry and she was driven out of her matrimonial home.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and has prayed for bail.
Learned counsel for the State as also learned counsel for the informant have opposed the prayer for bail.
In the facts of this case, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner Masehur Raja Khan, is hereby rejected.
