2/06.4.2015 All these three applications arise out of the same case and as such, they are being disposed of by this common order.
Heard learned counsel for the petitioners and learned counsel for
the State.
The petitioners have been made accused in connection with Bhandariya P.S case No.17 of 2009 corresponding to G.R No.480 of 2009, S.T Case No.158 of 2014 / S.T Case No.31 of 2014 / S.T Case No.157 of 2014, for the offence under Sections 147, 148, 149, 307 of the Indian Penal Code, Sections 27/ 35 of the Arms Act, Section 17 of the CLA Act and Sections 38/ 39 of the U.A.P Act.
From the F.I.R., it appears that there was an encounter between the police party and the members of the extremists group, but the extremists managed to flee away and no one was apprehended. There was no injury on the side of the police.
In the facts and circumstances of the case, I am inclined to enlarge the petitioners, Indrajit Yadav @ Indrajit JI, Rajesh Kumar Sinha @ Udai Ji, Gopal Korwa and Binay @ Nepali on bail. Accordingly, the petitioners, named above, are directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge II, Garhwa, in connection with Bhandariya P.S case No.17 of 2009 corresponding to G.R No.480 of 2009, S.T Case No.158 of 2014 / S.T Case No.31 of 2014 / S.T Case No.157 of 2014.
