2/ 06.04.2015 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.
The petitioner has been made accused for the offences under Sections 379, 411 / 34 of the Indian Penal Code, in connection with Piparwar P.S. Case No. 36 of 2014 corresponding to G.R. No. 648 of 2014.
From the FIR, it appears that two trucks loaded with allegedly illegal coal were apprehended. The petitioner is the owner of the said trucks.
In the facts of this case, I am inclined to enlarge the petitioner, Mahesh Prasad, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of Sri B. Bhagat, learned Judicial Magistrate 1st Class, Chatra, or his successor, in connection with Piparwar P.S. Case No. 36 of 2014 corresponding to G.R. No. 648 of 2014.
The aforesaid interlocutory application also stands disposed of.
