Heard learned counsel for the petitioner and learned counsel for
the State.
The petitioner has been made accused in connection with Saraiyahat P.S case No.172 of 2012 corresponding to G.R No.1003 of 2012, S.C No.87 of 2013, for the offence under Sections 304-B, 302, 34 of the Indian Penal Code.
The petitioner is the brother-in-law of the deceased and there is allegation against him also to have subjected the deceased to cruelty and torture for demand of dowry and to have committed her dowry death.
In the facts of this case, the petitioner being the brother-in-law of the deceased, I am inclined to enlarge the petitioner, Binoy Kumar Jha, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Dumka, in connection with Saraiyahat P.S case No.172 of 2012 corresponding to G.R No.1003 of 2012, S.C No.87 of 2013.
