The petitioner has been made accused for the offence under Section 395 of the Indian Penal Code, in connection with Garu P.S. Case No. 5 of 2001 corresponding to G.R. No. 139 of 2001, S.T. No. 49A of 2010.
The case relates to dacoity and the case was instituted against unknown. It is submitted by learned counsel for the petitioner that other co-accused, who had faced trial, has been acquitted after trial. The Judgment of the Trial Court has been brought on record.
In the facts of this case, I am inclined to enlarge the petitioner, Imran Khan, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned 1st Additional Sessions Judge, Latehar, in connection with S.T. No. 49A of 2010, arising out of Garu P.S. Case No. 5 of 2001 corresponding to G.R. No. 139 of 2001.
