The respondent no.4 to 6 have filed their counter affidavit in which statements have been made that the petitioner has already been given benefit of time bound promotion vide letter dated 17.5.1986; benefit of A.C.P. vide letter dated 16.12.2004; difference amount of Rs.17378/- on account of 5th Pay Revision for the period 1.4.1997 vide bill no. 194/99-2000. It is further submitted that difference amount on account of benefit of A.C.P, a sum of Rs. 7394/- has already been withdrawn by the department for payment to the petitioner. For revision of the pension petitioner is required to make an application in prescribed form. In this regard letters have been written on 7.1.2010 , 26.7.2010 and 9.9.2010 requesting the petitioner to turn up in the office to receive the difference amount of A.C.P. and sign the application for revised pension but he has not turned up. It is further been stated that for the claim of arrears of pay from January, 1999 to May, 1999 and December, 1999, allotment of funds were sought. However, learned counsel for the petitioner submits that payment has been made during the pendency of the writ application.
