Petitioner, who is a Medical Officer and working under the respondentHealth Department since 1990 has come before this Court for directing the respondents to accept his application for voluntary retirement made on 2.7.2012.

As per the respondents, the petitioner in-spite of submitting the relevant documents before the authorities for which he has also been noticed vide letter dated 13.10.2012(Annexure-C) to the counter affidavit has straightway moved this Court for issuance of a direction upon the respondents to accept his application for voluntary retirement.

Having heard learned counsel for the parties, in such circumstances, it appears that the petitioner is required to pursue his grievance before the competent authority under the respondent, department of Health, Medical Education and Family Welfare by submitting necessary details and documents as are relevant to enable the competent authority to arrive at a decision on his application for voluntary retirement.

Therefore, at this stage, without making any comment upon the merit of the claim of the petitioner, the writ petition is disposed of by giving liberty to the petitioner to approach the competent authority / respondent no.2, Principal Secretary, Health, Medical Education and Family Welfare Department, Government of Jharkhand for redressal of his grievance, which may be looked into in accordance with law.

The writ petition is disposed of in the aforesaid terms.
