This Court is well conscious of the circumstances in which the order of transfer can be interfered ordinarily i.e. if it is without jurisdiction or it is mala fide in nature or it is contrary to the statue. In the instant case, the said exercise appears to have made in the month of June and December, 2013 which is normal period of routine transfer, but this Court fails to appreciate as to why the person whose services if at all is required at the same place i.e. at Rural Works Sub Division under Bermo Division, he was transferred as Estimating Officer Works Division, Ranchi in June, 2013 and within six months he has again been transferred back on the said post in the same place in the subsequent exercise. This kind of action on the part of the respondents do create lot of feeling of unequal treatment and heart burn amongst the employees in the cadre. In the matter of enforcement of a policy relating to transfer, which is in vogue in the respondent-State and its department as well, ordinarily transfers are to be made after a tenure of three years, which is necessary to ensure efficiency and continuity in administration. However, for any administrative reason and in public interest transfer can be made within the said period.
