Let the District Education Officer, Khunti be impleaded as party respondent no. 5 in the instant writ petition for which necessary correction be carried out by the counsel for the petitioner during the course of the day in red ink.

Heard counsel for the parties.

The petitioner had approached this Court for redressal of his grievances relating to release of post retirement dues including outstanding dues of salary for which he had made representation before the respondent authority as well.

The petitioner is said to be a teacher retired from Project Balika High School, Khunti.

Instead of going into the details of the averment made by the petitioner, the matter can be cut short in view of the categorical statement made in the affidavit filed by the office of Accountant General, Jharkhand, Ranchi, respondent no. 3, para-4 thereof is quoted hereinbelow:-

“That so far relief claimed against the office of the answering respondent is concerned it is stated and submitted that the pension, gratuity and commuted pension in favour of the petitioner have already been authorized by the office of the answering respondent vide authority letter no. Pen-5-6555-60 dated 30/03/2012 and Pen-5-1842-44 dated 27/07/2012 respectively. The authority for payment of leave encashment for 300 days has also been issued vides Letter No. GE-7-M-Misc-3A-840 dated 15/12/2011.”

Apparently the grievances of the petitioner in relation to payment of pension, gratuity and leave encashment including commuted pension have been redressed by issuing authority letter itself indicated therein in the aforesaid quoted para.

Therefore, it appears that grievances of the petitioner have already been redressed. However, if the petitioner has any further grievance relating to claim for salary of Rs. 1,67,611/-, as stated on his behalf, for the period January, 2000 to November, 2000, the petitioner is at liberty to approach

respondent no. 5, the District Education Officer, Khunti for consideration of the same in accordance with law by filing a fresh representation. On receipt of such representation, the respondent no. 5, the District Education Officer, Khunti may consider his representation in accordance with law within a reasonable period.

Accordingly, the writ petition is disposed of in the aforesaid manner.
