The petitioner has been made accused in connection with Khunti P.S case No.110 of 2010 corresponding to Special Case No.57 of 2010, for the offence under Sections 161, 406, 409, 420, 467, 468, 471/ 34 of the Indian Penal Code read with Sections 7/ 13 (1-D) of the P.C. Act.
The petitioner was posted as Junior Engineer in the District Board, Khunti, and there is allegation of defalcation of an amount of Rs. 42.277 lakhs against the petitioner. The bail application of this petitioner was earlier rejected on merits by order dated 17.7.2013 in B.A No.1120 of 2013.
Learned counsel for the petitioner has renewed the prayer for bail, submitting that the petitioner is in custody since 13.4.2011 itself, but the trial has not yet concluded.
Taking into consideration the period of custody of the petitioner, I am inclined to release the petitioner, Ram Binod Prasad Sinha on bail. Accordingly, it is directed that the petitioner, named above, shall be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, Vigilance, Ranchi, in connection with Khunti P.S case No.110 of 2010 corresponding to Special Case No.57 of 2010.
