3/ 05.11.2014. Heard learned counsel for the petitioner and the learned counsel for the State.
The petitioner is apprehending his arrest in connection with Dhanbad P.S. Case No.110 of 2014, corresponding to G.R No.406 of 2014, for the alleged offence under Section 414 of the Indian Penal Code.
From the F.I.R. it appears that some stolen motorcycles were apprehended on the basis of the confessional statement of the apprehended co-accused. The petitioner has been made accused in this case only on the basis of the disclosure made by the co-accused.
In the facts of this case, I am inclined to grant anticipatory bail to the petitioner, Pradip Kumbhakar. Accordingly, it is directed that in the event of his arrest / surrender, the petitioner named above shall be released on bail, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Dhanbad, in connection with, Dhanbad P.S. Case No.110 of 2014, corresponding to G.R No.406 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
