3/07.11.2014 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner has been made accused in connection with Mandu (Kuju) P.S case No.325 of 2012 corresponding to G.R No.4797 of 2012, for the offence under Sections 363, 387, 341, 342, 323/ 34 of the Indian Penal Code.
There being allegation against the petitioner to have abducted and assaulted the informant for demand of levy, the bail applications of this petitioner were earlier rejected twice on merits.
Learned counsel for the petitioner has renewed the prayer for bail, submitting that the petitioner is in custody since 24.1.2013 itself and even though, the charge was framed on 5th August 2013, but not a single witness has been examined.
In the facts and circumstances of the case, I am inclined to release the petitioner, Suresh Kumar Sao @ Suresh Sao on bail. Accordingly, it is directed that the petitioner, named above, shall be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh, in connection with Mandu (Kuju) P.S case No.325 of 2012 corresponding to G.R No.4797 of 2012.
