Admittedly, the original licensee of the Fair Price Shop, who obtained licence under the Rules of Bihar Trade Articles(Licenses Unification)Order, 1984, applied for insertion of the name of writ petitioner in the said license. Subsequent to that entry, name of the petitioner was deleted against which the petitioner approached this Court by filing a writ petition being W.P.(C) No. 215 of 2012. The learned Single Judge observed that there is nothing on the record to show that the licence was granted on the application of the petitioner. Admittedly, as admitted by the learned counsel for the petitioner, the name of the petitioner was inserted in the license on the application filed by the respondent no.5 and the plea of the respondent-Department is that the name of the petitioner was deleted against which the respondent no.5 has no grievance and he has never raised any objection.
