2/02.04.2013: This application has been filed for modification of order dated 21.2.2013 passed in ABA No. 209 of 2013 whereby the petitioner has been granted anticipatory bail to the satisfaction of learned District and Additional Sessions Judge-IV, Hazaribagh in connection with S.T. No. 578 of 2011.

It appears that still the case is pending for commitment in the court of Sri Alok Kumar, Judicial Magistrate, Hazaribagh. Thus, in the bail order it was wrongly mentioned that the case is pending in the court of District and Additional Sessions Judge, Hazaribagh vide S.T. No. 578 of 2011.

Accordingly, learned counsel for the petitioner submits that aforesaid order may be modified by deleting the name of the court of District and Additional Sessions Judge-IV, Hazaribagth and S.T. No. 578 of 2011 and in its place Sri Alok Kumar, Judicial Magistrate, Hazaribagh be substituted.

Learned Additional P.P. has no objection in this respect.

Considering the aforesaid facts and circumstances, I allow this application and modify the order dated 21.2.2013 passed in ABA No. 209 of 2013 by deleting the name of the court of learned District and Additional Sessions Judge-IV, Hazaribagh and substituting it with the court of Sri Alok Kumar, Judicial Magistrate, Hazaribagh. S.T. No. 578 of 2011 is also hereby deleted from the aforesaid order.

In the said order, the date of surrender is also modified and it is hereby ordered that if petitioner surrender by 15.4.2013, the concerned Judicial Magistrate shall enlarge him on bail as ordered earlier in connection with Barhi P.S. Case No. 204 of 2011 corresponding to G.R. No. 1911 of 2011.
