along with respondent no. 5 participated in the tendering process initiated by the Executive Engineer RE Wing, Jammu vide e-NIT no. 109-REWJ of 2022 dated 13.07.2022. The respondent no. 5 and the petitioner were declared as L1 and L2 respectively for items 3 to 9.

It is alleged by the petitioner that respondent no. 5 was declared L1 but he could not meet the requirements of the tender notice and, therefore, was not awarded the contract. This petition is filed by the petitioner with the grievance that despite the lapse of more than three months, the respondents have not taken a decision to re-advertise the matter or award the contract to the petitioner who is L2.

While the matter was being heard, Mr. R S Jamwal, learned AAG appearing for the respondents brought it to the notice of the Court that the Executive Engineer RE Wing, Jammu has already allotted the work in question

in favour of respondent no. 5 vide order dated 10.10.2022. Faced with the aforesaid position, learned counsel for the petitioner prays for leave of this Court for withdrawal of the instant writ petition with liberty to file fresh challenging the allotment on all available grounds. The statement of learned counsel for the petitioner is taken on record.

Accordingly, the instant writ petition is dismissed as withdrawn with liberty as prayed for.
