Learned counsel for the parties submit that there are cases between the parties pending adjudication in High Court at Jammu and, therefore, it would be convenient for both the parties, if the complaint, which is spending on the files of Chief Judicial Magistrate, Doda is also transferred to one of the Judicial Magistrate, 1st Class at Jammu.
At the request of both the parties and also looking to their convenience, File No.117/Complaint titled Mohd. Shafi v. Time Chand, pending on the files of Chief Judicial Magistrate, Doda is transferred to Chief Judicial Magistrate, Jammu,. The Chief Judicial Magistrate, Doda shall transmit the record of the to Chief Judicial Magistrate, Jammu who, upon receipt of the file may either himself try the complaint or transfer it to any competent court of jurisdiction at Jammu. Chief Judicial Magistrate, Jammu or Judicial Magistrate 1st Class, upon receipt of the record of the file, shall put both the parties to notice before proceeding further in the matter.
Disposed of accordingly.
