This is an application for condonation of delay in filing the application seeking permission of this Court for filing acquittal appeal against judgment dated 25^th September, 2017 passed by the learned Sessions Judge in file No.48/challan titled State v. Baldev Raj.

The application, for the reasons stated therein, is allowed. Delay in filing the application seeking leave to appeal is condoned.

Heard learned counsel for the parties and perused the impugned judgment.

It is submitted by learned counsel for the petitioner that the trial Court has failed to appreciate the evidence in proper perspective and has without any justifiable reason given the benefit of doubt to the respondent.

Prima facie, there is material to argue the appeal as some of the witnesses have supported the prosecution version. Accordingly, this application, for the reasons stated therein, is allowed and leave to appeal against the judgment of acquittal is granted.

Registry to diarize the appeal and list the same for consideration on 21^st December, 2021.
