petitioner has been charged for commission of offence under Sections 120B/420/467/468/471 RPC by the Court of learned 3^rd Additional Sessions Judge, Jammu (“trial Court”) .

As is evident from the impugned order, charges were framed on 17.05.2010 and since there was no interim stay on the trial from this Court, the trial Court must have proceeded with the trial of the case.

Learned counsel for the parties have stated at Bar that the trial has now reached its final stage, therefore, it would be futile to go into illegality or otherwise of the charges framed against the petitioner as anything said by this Court at this stage would not be in the interest of both the parties.

Having regard to the submissions coupled with the statement made at Bar, this revision petition is disposed of by leaving it open to the petitioner to raise all available pleas including those raised in this petition at the time of final

consideration of the challan. Needless to say, as was provided by this Court vide order dated 25.11.2010, the trial court shall not insist the personal presence of petitioner unless it is otherwise required by law.
