The present application has been 昀椀led for converting the appeal from under Section 419 of Bharatiya Nagrik Suraksha Sanhita, 2023 (BNSS) to under Section 14A of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (SC&ST Act).

It has been asserted that there is speci昀椀c provision under Section 14A of the SC&ST Act to 昀椀le an appeal against the acquittal, sentence or bail order. The appeal was wrongly 昀椀led under Section 419 of BNSS. Hence the present application.

Learned counsel for the respondent has submitted that he has no objection in case the present application is allowed.

In view of the above statement of the learned counsel for the respondent as well as the fact that Section 14A of the SC&ST Act provides for a direct appeal to the High Court against any judgment, sentence, or order (excluding interlocutory orders) of a Special or Exclusive

Special Court. It overrides the Code of Criminal Procedure (Cr.PC) for both convictions and bail orders, the present application is allowed and the present appeal is ordered to be converted into one under Section 14A of SC & ST Act.
