Respondent-plaintiff, Sh. Dev Bhagat Negi, identified
by his learned counsel, has attended today’s hearing in person. He got his statement recorded on oath to the effect that apart from the amount already paid to him by the appellant-defendant, Dr. Narinder Bharti, and the amount deposited by Dr. Narinder Bharti in the Court of learned District Judge, Rampur, H.P. in Civil Appeal No.53 of 2008, he has no further surviving claim against the appellant-defendant in respect of the dispute involved in the matter. He has also stated that he has settled the dispute involved in the matter with the appellant-defendant.

2. In view of the statement of Sh. Dev Bhagat Negi, learned counsel for the appellant-defendant does not press the instant appeal and states that the appellant has no objection to release of the amount deposited by him in the Court of learned District Judge, Rampur, in Civil Appeal No.53 of 2008 in favour of the respondent.
3. Having regard to the above developments and in light of the statement and stand taken by the parties, this appeal is accordingly disposed of as not pressed. The respondent shall be at liberty to withdraw the amount stated to have been deposited by the appellant in the Court of learned District Judge, Rampur in Civil Appeal No.53 of 2008 by moving appropriate application. The pending miscellaneous application(s), if any, also stand disposed of.
