In this appeal, judgment and decree dated 21.9.2006 passed by learned District Judge, (Forest) Shimla in Civil Appeal No. 63-S/13 of 2005 is under challenge. As a matter of fact, learned lower Appellate Court on dismissal of the appeal has affirmed the judgment and decree passed by learned Civil Judge (Junior Division), Court No. 3, Shimla in Civil Suit No. 2/1 of 2002 whereby the suit for permanent prohibitory injunction filed by the appellant was dismissed.

an outside court settlement i.e. by way of mediated settlement. The compromise deed is Ext.C1 which has been tendered by the appellant-plaintiff in her statement recorded separately. The respondent-defendant who is preset in person also admits the contents thereof to be true and correct. His statement has also been recorded separately. Besides the parties to the present lis, learned counsel representing them have also signed this document in token of the amicable settlement in the manner as prescribed therein.
