Evidently, this Court while disposing of the writ petition finally proceeded on the basis that the impugned order dated 17.07.2006 (Annexure P-1) had been passed by the Labour Commissioner and accordingly directed him to make a reference to the Industrial Tribunal-cum-Labour Court. Whereas, the petition was infact directed against the award passed by the Labour Court itself.
