Mr. J. Chutia, learned Standing Counsel, Karbi Anglong Autonomous Council, appears for respondent Nos. 1, 2 & 3 and Mr. R. Dhar, learned Additional Senior Government Advocate appears for the respondent Nos. 4 & 5.

The father of the petitioner, Late Har Sing Teron, while serving as GradeIV employee (Watchman) under the establishment of Assistant Director of Agriculture (Farm), Large Sized Mechanized Farm, Kheroni, died in harness on 30.06.2007. During the time of death of the petitioner’s father, the petitioner was a minor. After attaining the age of majority, the petitioner made an application for appointment on compassionate grounds, which was forwarded by the Assistant Director of Agriculture (Farm), Large Sized Mechanized Farm, Kheroni to the Additional Director of Agriculture (Hills), Diphu, Karbi Anglong by forwarding Letter dated 24.08.2021. The case of the petitioner is that his case is yet to be considered by the District Level Committee. Mechanized Farm, Kheroni on 22.05.2023. The petitioner also made a representation on 02.10.2023 before the Additional Director of Agriculture (Hills), Diphu, Karbi Anglong (W) Assam, praying for consideration of his appointment on compassionate grounds. Both the representations are yet to be disposed of till date.

Mr. J. Chutia, learned Standing Counsel, Karbi Anglong Autonomous Council, submits that when the father of the petitioner died, he was a minor and the petitioner made his application only after attaining the majority after a lapse of 14 years and therefore, on this ground alone, this writ petition should be dismissed. He, however, submits that in the interest of justice, the representation made by the petitioner may be directed for disposal within a specific period of time.

After hearing the learned counsel for the parties and on consideration of the materials available on record, this writ petition is disposed of directing the Additional Director of Agriculture (Hills), Diphu, Karbi Anglong (W) Assam to dispose of the representation, dated 02.10.2023, made by the petitioner within a period of 4 (four) weeks, in accordance with law, from the date of receipt of a certified copy of this order.

With the above observations and directions, the instant Writ Petition is disposed of.
