Heard Mr. A.D. Choudhury, learned counsel for the applicant. Also heard Mr. P.S. Bhattacharjee, learned CGC appearing for the respondent.

The present application has been so instituted praying for a clarification of the order dated 27.06.2024 passed by this Court in WP(C) 5347/2020. This Court vide the said order had required the respondents to release to the petitioner Society an amount of Rs.2,03,660/- on submission of receipt for the same by the society within 15 (fifteen) days thereafter along with an interest @9% per-annum from the date, the said amount was so made.

The Court having not specified the date from which the interest is to be calculated, it is the contention of the applicant that the respondents have not released the interest component working out on account of the pendency of the said amount of Rs.2,03,660/-

Upon hearing the learned counsel for the parties, this Court clarifies that the interest as awarded by this Court vide the order dated 27.06.2024 @ 9% shall be applicable from the date the amount i.e. Rs.2,03,660/- was so sanctioned for payment vide communication dated 28.02.2013.

Accordingly, the respondents shall now calculate the interest so payable to the applicant society on the amount of Rs.2,03,660/- @ 9% w.e.f. 28.02.2013 and release the same at the earliest. However, the interest shall be so calculated till the date the said amount was so paid to the applicant society.

With the above observation and direction, the I.A. stands disposed of.
